Friends,
We have some really good news to share. On April 22nd the hearing regarding PWEP's standing took place at the courthouse in Brampton. We have just received the court's decision: PWEP has been granted standing! This means that the judicial review PWEP has brought against the Tidman development will be allowed to proceed. The next step will be a hearing on the actual merits of the case, which will take place at the earliest this fall. We enter into this next phase with an even stronger case, thanks to the judge's decision on standing, and we are more confident than ever that we will achieve a positive outcome.
None of this would have been possible without you and your unwavering support, so we want to take this opportunity to thank each and every one of you. This is a big win for all of us! And once again, this goes to show what a community can achieve if we continue to stand together. We know that this might sometimes feel like a long, arduous road, but that's why it's so important to celebrate our victories, and this is one of them! Rest assured that we are in this for the long-haul, and we will continue to give it our all.
Comprehensive Zoning By-Law
In other news, the Kincardine Comprehensive Zoning By-Law was approved by council, as expected. You can access the notice and related materials here. Many of you commented on the plan, as did PWEP, and we have been assured by municipal and county planning officials that our concerns and requests, especially pertaining to the designation of Inverhuron as a Primary/Secondary Urban Community, will be addressed through the County Official Plan Review, which is still underway. Any upper-tier decisions related to Land Use will subsequently be incorporated into the local municipal plan. We remain actively engaged in these consultations.
Expansion of Tiverton Water Supply System
Also of note is the municipality's proposal to expand Tiverton's water supply by potentially connecting to the Kincardine drinking water system via a booster pumping station located at 3194 Bruce Road 15 in Inverhuron and a water main connection along Bruce Road 15. There will be a public meeting on Friday, May 23, 2025, 4 - 6 p.m. at the Whitney Crawford Community Centre, 6 McKay Street, Tiverton. You can access the notice here. Bill 5, the Protect Ontario by Unleashing our Economy Act
Last but not least, we want to alert you to the opportunity of commenting on the government's proposed Bill 5, which would slash environmental protections by crippling Ontario's Endangered Species Act, "once considered among the best provincial at-risk species laws in Canada" (Narwhal Bulletin, May 15th). You can access CELA's summary here, and read the Narwhal's excellent coverage on this issue here. If you wish to comment, you can do so on Ontario's environmental registry. The deadline is tomorrow, May 17th by midnight. This is an important opportunity to let our elected officials know that we are watching, and that we do not agree with a development at all costs policy that harms the environment, erodes constitutionally guaranteed First Nation's rights, and further limits public oversight.
